General terms and conditions of sale

This document is drafted in French, which is the only authoritative language. Its English, Spanish, Italian and German versions are courtesy translations: in the event of any discrepancy, the French version prevails.

1. Purpose and customers

These terms govern the sale of credits for the Swan service, published by 410-GONE.FR (see the legal notice), and of the related support services. Any order entails their unreserved acceptance.

The service is intended exclusively for professionals acting in the course of their business. By creating an account, the customer declares that they are acting for professional purposes; the provisions of the French Consumer Code (Code de la consommation) do not apply to these terms.

2. Credits

Use of the service is paid for in credits, debited at the time of the action:

  • creating a project: 1 credit per 250 estimated URLs across the whole project, rounded to the nearest whole number, with a minimum of 4 credits (up to 1,000 URLs);
  • changing a source or test domain: 1 credit per domain changed;
  • increasing the URL quota: each credit raises the quota of every domain in the project by 250 URLs.

This price schedule is shown in the customer area. An action is carried out only if the balance covers it.

3. Prices and payment

The unit price of a credit, which decreases with the quantity purchased, is displayed in euros excluding tax on the pricing page and on the purchase screen. VAT at the applicable rate is added. The applicable prices are those displayed on the date of the order.

Payment is made online by bank card, through Stripe; no card data passes through the publisher’s servers. Credits are added to the account as soon as Stripe confirms the payment. A billing address is requested before purchase: it is required to issue a compliant invoice.

4. Invoices

An invoice is issued for each purchase and made available in the customer area. Invoices are kept for ten years, the statutory retention period for accounting records.

5. Validity period of credits

A purchased or free credit is valid for twelve months from its acquisition. The credits that expire soonest are used first, credits without an expiry date last. The next expiry date is displayed in the customer area. On expiry, unused credits are forfeited; they do not give rise to any refund. The same applies to the credits of an account anonymised after three years without logging in (see the data use policy).

Credits acquired before this version of the terms was published carry no expiry date.

6. Refunds

Credits are neither refundable nor transferable to another account. The fourteen-day right of withdrawal does not apply, as the service is reserved for professionals.

7. Support on quotation

Support services (migration carried out with the 410-GONE.FR team, high-volume websites) are subject to a quotation. The accepted quotation sets out their content, price and timescales; these terms apply to all other matters.

8. Availability

The publisher uses reasonable means to ensure the availability of the service, without any service level commitment in the absence of a specific contract. An action that fails because of the service, an interrupted crawl for example, does not entail the loss of the credits it consumed: it can be restarted.

9. Liability

The service is a decision-making aid: the customer validates the redirect plan and decides when it goes live. The publisher guarantees no SEO results. Its liability is limited to direct damage and capped at the sums paid by the customer during the twelve months preceding the event giving rise to the claim.

10. Personal data

The data required for the order and for invoicing are processed in accordance with the data use policy.

11. Governing law and jurisdiction

These terms are governed by French law. In the event of a dispute, the parties shall endeavour to reach an amicable solution. Failing agreement within thirty days of its notification, exclusive jurisdiction is conferred on the courts of Lyon having jurisdiction in commercial matters (juridictions de Lyon compétentes en matière commerciale).
